The Grand panel of IP High Court found patent infringement under the doctrine of equivalents in the patent infringement case filed by Chugai Pharmaceuticals against generic manufacturers. The Tokyo District Court found infringement under the doctrine of equivalents December, 2014 and the IP High Court affirmed the lower court decision. The doctrine of equivalents was invoked for the first time in Japan in this case in the pharmaceutical art. City-Yuwa Partners represents Chugai Pharmaceuticals.
